Terms & Conditions

1. Acceptance of Terms

By purchasing a ticket to, or attending, any Dayshift event (Event), you agree to be bound by these Terms and Conditions, any venue-specific rules, and all applicable laws, including the Australian Consumer Law under the Competition and Consumer Act 2010 (Cth) and the Fair Trading Act 1987 (NSW).

2. Australian Consumer Law

Nothing in these Terms and Conditions excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law or NSW consumer protection laws that cannot lawfully be excluded.

To the fullest extent permitted by law:

  • services are provided subject to factors outside our reasonable control; and
  • you acknowledge that live events carry inherent risks, variables, and circumstances that may affect your experience.

3. Orders and Ticket Purchases

All orders placed through our website are subject to acceptance. We reserve the right to refuse or cancel any order for any reason, including where there are limitations on quantities available for purchase, inaccuracies, or errors in ticket, product, or pricing information.

All ticket and merchandise prices are listed in AUD and are subject to change without notice until the order is confirmed.

Payment must be received and verified before any order is processed.

4. Product Availability and Merchandise

All merchandise is subject to availability. Some merchandise may be available only in limited quantities for particular events.

We make every effort to ensure the accuracy of product descriptions, images, and pricing. However, errors may occur, and we reserve the right to correct them.

Shipping costs for merchandise are calculated at checkout. We are not responsible for delays caused by shipping carriers or customs.

Returns, exchanges, and refunds for merchandise are governed by our Refund Policy and your rights under Australian Consumer Law.

5. Event Changes and Line-Up

You acknowledge and agree that the Event line-up, artists, schedule, set times, venue areas, and overall format may change without notice.

The absence, cancellation, or substitution of any advertised artist, including one or more artists, does not constitute a major failure and does not entitle you to a refund, to the extent permitted by law.

Changes to supporting acts, performance duration, running order, or similar aspects of the Event are at the organiser’s discretion.

6. Weather Policy

Dayshift events may be held outdoors or partially outdoors and will proceed in most weather conditions.

No refunds, exchanges, or credits will be provided due to weather conditions, including rain, storms, heat, wind, or other adverse weather, where the Event proceeds, unless required under Australian Consumer Law.

You acknowledge that weather conditions may affect your comfort and enjoyment of the Event.

An Event will only be cancelled, postponed, interrupted, or modified where necessary for safety, legal, operational, or other reasonable reasons.

7. Refunds, Exchanges, and Cancellations

To the fullest extent permitted by law, all ticket purchases are final and no refunds, exchanges, or cancellations will be provided for:

  • change of mind;
  • inability or failure to attend;
  • personal circumstances;
  • dislike of music volume, genre, artist performance, or programming;
  • venue conditions, including queues, bar service, toilet facilities, or security processes;
  • minor changes to the Event, including line-up, set times, running order, or format; or
  • weather-related discomfort or inconvenience where the Event proceeds.

Refunds will only be provided where:

  • the Event is cancelled and not rescheduled; or
  • required under Australian Consumer Law, including where there is a major failure.

If the Event is postponed or rescheduled, tickets will remain valid for the new date unless otherwise required by law.

8. Venue Operations and Third Parties

You acknowledge that Events may be held at third-party venues and may involve third-party contractors and service providers.

To the fullest extent permitted by law, we are not responsible for venue operational matters, including:

  • security personnel;
  • entry processes;
  • bar service and wait times;
  • toilet facilities;
  • crowd management; or
  • other services provided by third parties.

These matters do not entitle you to a refund, exchange, compensation, or damages unless required by law.

9. Entry Conditions

Entry is subject to venue capacity, licensing requirements, safety rules, and security procedures.

We reserve the right to refuse entry or remove any person from the Event for safety, behavioural, licensing, compliance, or operational reasons, without refund, to the extent permitted by law.

10. Health and Safety

You must comply with all lawful directions given by event staff, venue staff, security personnel, and relevant authorities.

Failure to comply may result in refusal of entry or removal from the Event without refund, to the extent permitted by law.

11. Assumption of Risk and Personal Responsibility

By attending the Event, you accept and assume all inherent risks associated with attendance, including but not limited to:

  • personal injury;
  • hearing damage;
  • crowd-related incidents;
  • slips, trips, or falls;
  • weather exposure; and
  • the actions of other patrons.

You are responsible for taking reasonable precautions for your own health, safety, and personal property while attending the Event.

12. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any loss, damage, injury, cost, or expense suffered as a result of:

  • weather events or other acts of God;
  • artist cancellations or changes due to illness, travel disruption, or other unforeseen circumstances;
  • government directions, public health orders, or restrictions;
  • technical failures, delays, interruptions, or outages; or
  • the acts or omissions of third parties, including venues and contractors.

Where liability cannot lawfully be excluded, our liability will be limited, at our option, to:

  • resupplying the relevant services; or
  • paying the cost of having the relevant services resupplied.

13. Force Majeure

We are not liable for any failure or delay in performing our obligations where that failure or delay arises from events beyond our reasonable control, including:

  • severe weather;
  • natural disasters;
  • pandemics;
  • government restrictions or directions;
  • transport disruptions, including cancelled flights affecting performers;
  • utility outages; or
  • venue closures.

14. Photography and Media

By attending the Event, you consent to being photographed, filmed, or otherwise recorded. You agree that any such material may be used by us for marketing, promotional, editorial, or commercial purposes without compensation or further notice.

15. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes arising in connection with these Terms or the Event are subject to the exclusive jurisdiction of the courts of New South Wales.

16. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue in full force and effect.

18. Important Notice

These Terms and Conditions are intended to operate subject to Australian Consumer Law. They do not override any statutory rights or remedies that cannot lawfully be excluded, including rights that may arise where there is a major failure.
